Te Wānanga o Aotearoa Collective Agreement

Bargaining”  Update “ - 18 December 2009

E ngā mema o Te HautūKahurangi o Aotearoa, tēnā rā koutou katoa

He hōnore, he korōria, he maungaroa ki te whenua, he whakaaro pai ki ngā tāngata katoa.”  Ko ngā mihi nui ki a koutou me ngā tini āhuatanga o te wā.” 

Your bargaining team (Te Aroha Lemke [Raroera], Gwen Basley [Papaiōea], Russell Taylor [TEU advocate], and Lee Cooper [TEU assistant advocate]) have met with the employer team on 3 occasions across 6 days from October through December.” 

“ This report is a bargaining update for your information.

No settlement has been achieved to date i.e. we are apart on the money – the employer is offering 2% from 1 January 2010 and we are still seeking 3.2%

We anticipate all “ members will discuss where we are at , determine whether we send it to”  ratification voteballot”  or will we look at a an option of taking a vote on industrial action by early in New Year at the TWOA TEU Branch AGM at Te Aute College on 21 or 22 January.

The negotiating team will be guided by the feedback from members on the preferred course of action.”  So please let your team know what you think.

The offer is less than the minimum settlement point we were given at the pre meetings. The offer is realistic compared to other settlements in the sector but it just maintains purchasing power against rising costs as at this point. There have been no concessions and there have been some improvements as noted below:

The draft and not agreed Proposed Terms of Settlement are (attached) the key points include the following:

  • -noho marae- payment allowance” of $125 for designated “in charge” overnight
  • -qualification training allowance
  • -eliminated six month qualifying period for bereavement/tangihanga leave
  • -updated motor vehicle mileage reimbursement and Life insurance
  • -include five factors that MUST be considered in salary setting, reviews, and appeals

All other claims of both parties are withdrawn and all those relating to improving leave will be considered during the term of the proposed CEA by a cultural advisory committee, if settlement is reached.

We have consulted with Tank and Angelina from TUIA who are at a similar point and we have committed to keep them in touch with where we are at and vice versa.

In meantime we need to get those 200 staff of TWOA who are not in any union to join up. We have had a couple of members transfer from TUIA.”  The TUIA CEA has expired so staff can not only change Unions they can also change collective agreements.

Draft and not agreed Proposed Terms of Settlement – 11 December 2009

TEU, Te Wānanga o Aotearoa Collective Agreement

“ The following are the proposed terms of settlement, subject to ratification, reached between the TEU Union and Te Wānanga o Aotearoa

1.4″ ” ” ” ” ” ” ”  Term of the Agreement

This agreement shall come into force from the date of ratification subject to the agreement reached in clause 4.8.1 and expire on 30 August 2010.” ” ” ” ” ” 

5.3.2. change rate from $0.50 cents to $0.62 cents.” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” 

5.6″  “ ” ” ”  change insured sums from $30,000 to $60,000 where appropriate. The sum insured shall be reviewed by the employer periodically and the max sum insured shall be communicated on Te Kete. If there is any rate drop contemplated then the TEU shall be consulted.

6.2.6 “ ” Noho sleep over payments.

Employees who are required to sleep overnight at Noho delivering education programmes to Tauira shall be paid $125.00 (gross) for each completed night. This payment will need to be approved in advance in writing by the line manager at the time the noho application is submitted.

“ ” ” ”  This arrangement shall apply from 1 January 2010..

7.3.6 For employees who are required and agree to undertake and complete a course of training required by the employer:

a)”  A training allowance will be paid for the period agreed between the parties that will allow reasonable time for the qualification to be attained by” an agreed specific date. The training allowance is for an identified fixed sum and is paid with salary.

b) In the event the employee does not attain the qualification required by the due date, the parties shall review the reasons for the non completion. The allowance shall cease to be paid from the end of the agreed period unless the review determines otherwise. The remuneration payable to the employee from that date on shall be the amount shown as base salary.

c) Both a and b above shall attract negotiated salary increases.

d) In the event the employee attains the required qualification by the due date, the allowance shall be added to the base salary to form the new base salary from the date the qualification is achieved.

e) In the event that the employee loses the training allowance and they subsequently attain the required qualification, then the value of the training allowance shall be added to the base salary with effect from the date the qualification is attained. There shall be no backdating of the training allowance to cover the time required beyond the loss of the allowance and the attainment of the qualification.

f) The training allowance will be included in paid leave and redundancy compensation calculations.

Add new sub-clauses 4.2.4:

4.2.4″ ”  Remuneration will be determined by TWoA for each employee by taking into account the following factors:

(a)” ” ”  internal relativities;

(b)” ” ” ” ” ” ” ”  the relevant skills, qualifications, and experience of the employee;

(c)” ” ” ” ” ” ” ”  the ease or difficulty in recruiting and/or retaining the specific skills and/or experience required for the position;

(d)” ” ” ” ” ” ” ”  performance of the employee in their role; and

(e)” ” ” ” ” ” ” ”  job size.

.8.1 “ ” ” ”  Union claim 3.2%, current employer offer 2.0%”  Not yet agreed.

4.8.1.”  All TEU members employed at TWoA as at 01 January 2010 shall receive a TBA% increase to their personal salary.

8.3.1″ ” ” ” ”  Qualifying for Sick Leave and Bereavement Leave

(a)” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ”  A permanent fulltime or part-time employee qualifies for an annual entitlement of sick leave after he/she has completed six months current continuous employment with the employer.

(b)” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ” ”  Once the employee has qualified for an entitlement to sick leave, the entitlement exists through the 12 month period of continuous employment, which begins at the end of the 6″ month qualifying period, and applies for each subsequent 12 months of current continuous employment thereafter.

Delete 8.3.4 e.

The negotiators for the parties agree that these are the proposed terms of settlement that will be submitted for ratification.
